Supreme Court justifies reinstating Justice Honyenuga in Opuni trial

A seven-member panel of the Supreme has provided its reasons to justify the reinstating of Justice Clemence Honyenuga in the trial of Dr Stephen Kwabena Opuni in a 4-3 majority.

For the four justices on the majority side who granted the review application, it was Justice Gertrude Torkornoo who provided the template and her views were supported by Justice Jones Dotse, the presiding judge, Justice Lovelace Johnson and Justice Prof Nii Ashie Kotey.

It was the reasoning of Justice Torkornoo that, the ordinary bench’s decision will not hold the administration of justice delivery.

For Justice Amadu Tanko, Justice Gabriel Pwamang and Justice Agnes Dordzie, who dissented, the review application did not provide any exceptional circumstances for it to be reviewed.

In a 78-paged judgment, the judge who dissented were of the view that the judge should not be allowed to continue presiding over the case.
